Terms of Service

These Terms of Service ("Terms") govern your use of Panoptik's website, applications, and related services (together, the "Services"). The Services are provided by Panoptik AI Ltd, a company based in the United Kingdom ("Panoptik", "we", "us", or "our"). By using the Services, you agree to these Terms.

1. Who may use the Services

You must be at least 18 years old and able to enter into a binding agreement to use the Services. The Services may be used by individuals, enterprises, and public-service organisations. If you use the Services for an organisation, you confirm that you have authority to accept these Terms for that organisation.

2. Your account and responsibilities

You must provide accurate account information, keep your credentials secure, and promptly tell us if you believe your account has been accessed without permission. You are responsible for activity that occurs through your account.

3. Acceptable use

You must not use the Services to:

• break the law or infringe another person's rights, privacy, or intellectual property;
• upload or process content that you do not have the right to use;
• interfere with, disrupt, probe, or bypass the security or operation of the Services;
• reverse engineer, decompile, or attempt to extract source code except where applicable law permits it;
• use automated means to access the Services without our written permission; or
• use the Services in a way that could harm people or create unlawful discrimination.

4. Your content and our intellectual property

You retain ownership of the images, searches, and other content you submit to the Services ("Your Content"). You grant us a limited right to host, process, analyse, and display Your Content only as needed to provide, secure, and improve the Services. You are responsible for ensuring that Your Content and its use through the Services comply with these Terms and applicable law.

Panoptik and its licensors retain all rights in the Services, including their software, branding, and underlying technology. Subject to these Terms, we give you a limited, non-exclusive, non-transferable right to use the Services.

5. Paid Services

Paid plans are subscription-based and may renew automatically unless cancelled before the next billing period. Fees and billing terms shown when you subscribe form part of these Terms. Payment processing is provided by Stripe. Fees are non-refundable except where required by law. We may change prices for a future billing period by giving you reasonable notice.

6. Availability and changes

We work to keep the Services available and reliable, but they are provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue parts of the Services when reasonably necessary, including for maintenance, security, or legal reasons.

7. Disclaimers and limitation of liability

The Services provide tools to support analysis; they do not guarantee the accuracy, completeness, or suitability of any result or location hypothesis. You are responsible for independently assessing results and for decisions made using the Services.

To the fullest extent allowed by law, Panoptik's total liability arising from or relating to the Services is limited to the fees you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive losses. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

8. Ending use of the Services

You may stop using the Services at any time. We may suspend or end your access if you materially breach these Terms, create risk for us or others, or where we are required to do so by law. Sections that by their nature should continue, including those about intellectual property, disclaimers, liability, and governing law, will survive termination.

9. Changes to these Terms

We may update these Terms from time to time. When we do, we will publish the revised version here and update the effective date. Continued use after the effective date means you accept the updated Terms.

10. Governing law and contact
